RV Purchases and Motor Home
Buys: Your Legal Rights to Benefits
We specialize in helping California RV owners
recover money owed them by
California RV dealers for an RV purchase scam or a sale
or lease contract that violates California law. These
scams may have improperly increased your sales price, tax, license,
and registration costs. We handle all details; you do not have
to negotiate with the dealer or worry about the court filings.
We are California licensed attorneys and are paid only if we recover
for you.
If you experienced any of these eight RV purchase scams, we may
be able to obtain cash or other legal benefits for you:
| # 1 Scam:
Unwanted accessories included in contract |
Dealer
Tells You: |
"These accessories are included in the
RV." Dealer does not tell you that accessories are optional
and that you are being charged for them. |
What
Dealer
Does: |
Quotes you a monthly payment. When you agree,
dealer adds extra accessories -- an alarm, paint/fabric protection,
window etching, low jack , service contract, GAP insurance,
or other items -- into the contract to reach the payment you've
agreed to. Dealer doesn't tell you he is charging you for
the accessories and that you could reject them. The dealer
usually puts a high price on the accessories. |
What
It
Costs You: |
The cost of the unwanted accessories - often
hundreds of dollars. |
What
To Do: |
Call Rosner, Law & Mansfield toll-free
at (800) 466-5366 for a free, no-pressure consultation.
If your dealer broke the law, we may be able to get a cash
settlement or other legal benefit for you. We are paid only if we recover for you. |
| # 2 Scam:
Backdated contract, usually at a higher interest rate |
Dealer
Tells You: |
"You didn't qualify for the financing under
the first contract. You need to come back and sign a second
contract." Dealer does not tell you that you can get
your deposit back and return the RV instead. |
What
Dealer
Does: |
Backdates the second contract to the date of
the first contract. Sometimes adds a form called "Acknowledgement
of Rewritten Contract." Second contract usually has higher
financing charges. |
What
It
Costs You: |
Extra interest you wouldn't have paid if the
second contract was dated properly. Plus, you are stuck with
an RV at a higher interest rate, when you might have returned
it and gotten your deposit back if you had known you could. |
What
To Do: |
Call Rosner, Law & Mansfield toll-free
at (800) 466-5366 for a free, no-pressure consultation.
If your dealer broke the law, we may be able to get a cash
settlement or other legal benefit for you. We are paid only if we recover for you. |
| # 3 Scam:
"Hold check" agreement with multiple deposit checks
|
Dealer
Tells You: |
"Rather than paying the entire down payment
at once, just make out post-dated checks and we will hold
them for later deposit. Sign this hold-check agreement that
you understand what we are doing for you." |
What
Dealer
Does: |
California law says the dealer must list all
down payments and the dates they will be made in a 1 (one)
document purchase contract. Dealer does not do this - he uses
the hold check agreement, which breaks the law. |
What
It
Costs You: |
Extra expenses, such as attorney fees and returned-check
fees, that are part of the hold-check agreement. |
What
To Do: |
Call Rosner, Law & Mansfield toll-free
at (800) 466-5366 for a free, no-pressure consultation.
If your dealer broke the law, we may be able to get a cash
settlement or other legal benefit for you. We are paid only if we recover for you. |
| # 4 Scam:
Used RV with hidden problems |
Dealer
Tells You: |
"This is a nice used RV. We've inspected
it." |
What
Dealer
Does: |
Conceals facts the dealer knows about the RV.
Dealer MUST tell you when it knows that a used RV is or was:
1) Significantly ("materially") damaged
in an accident
(even if damage was repaired);
2) Rented out for use
3) Bought back because of a defect (was a "lemon")
4) Shows a wrong odometer reading |
What
It
Costs You: |
An RV that doesn't drive well or has mechanical
problems, and may be unsafe. Lots of money spent on repairs. |
What
To Do: |
Call Rosner, Law & Mansfield toll-free
at (800) 466-5366 for a free, no-pressure consultation.
If your dealer broke the law, we may be able to get a cash
settlement or other legal benefit for you. We are paid only if we recover for you. |
| # 5 Scam:
New RV is really a used RV |
Dealer
Tells You: |
"This is a brand-new RV." |
What
Dealer
Does: |
Doesn't tell you this RV cannot be called "new"
under California law.
It must be sold as a USED RV if it was:
1) Used as a demo by the dealer
2) Sold and then returned by another buyer |
What
It
Costs You: |
A used, overpriced RV that you could buy for
less if the dealer told the truth. Plus, you don't get the
new RV you bargained for. |
What
To Do: |
Call Rosner, Law & Mansfield toll-free
at (800) 466-5366 for a free, no-pressure consultation.
If your dealer broke the law, we may be able to get a cash
settlement or other legal benefit for you. We are paid only if we recover for you. |
| #
6 Scam: Discussions in Spanish, but contract in
English |
Dealer
Tells You: |
"Se habla Español." |
What
Dealer
Does: |
Negotiate the terms of the car purchase or lease
in Spanish. But the contract is in English. Doesn't tell you
that under California law, you are entitled to an RV purchase
contract in Spanish if you and the dealer negotiated in Spanish. |
What
It
Costs You: |
You don't fully understand the contract, so
you may end up paying more money or getting a used RV that
you thought was new. |
What
To Do: |
Call Rosner, Law & Mansfield toll-free
at (800) 466-5366 for a free, no-pressure consultation.
If your dealer broke the law, we may be able to get a cash
settlement or other legal benefit for you. We are paid only if we recover for you. |
| # 7 Scam:
Customer signature forged by dealer |
Dealer
Tells You: |
"We have the documents filled out for this
RV purchase." |
What
Dealer
Does: |
Forges your signature on:
1) A contract with higher rates than the one you
signed
2) A credit application (with false claims about
your income)
3) A buyer's guide
4) Forms (never seen by you) listing problems
with the RV |
What
It
Costs You: |
More money, legal responsibility for things
you did not agree to,
arrest & criminal prosecution for a false credit application. |
What
To Do: |
Call Rosner, Law & Mansfield toll-free
at (800) 466-5366 for a free, no-pressure consultation.
If your dealer broke the law, we may be able to get a cash
settlement or other legal benefit for you. We are paid only if we recover for you. |
